The SCOTUS disagreed. The states sued the fed to stop ACA on just that point...and lost. I think the court erred, but that was their ruling: you can be fined if you don't carry equivalent level insurance.
Doesn't sound American does it?

The courts said it amounts to a tax, and the guvmint is able to tax......and boy are they taxing!
